Delhi HC imposes ₹1 lakh cost on ‘Devtol’, restrains firm from using the mark, Dettol wins Trademark Infringement Suit

The Delhi High Court has ordered a company (Mohit Petrochemicals Pvt Ltd) to stop using the mark ‘Devtol’ (TM Application Number 4494428) for manufacturing and selling its hand sanitizers, saying it infringes the trademark and logo of well-known antiseptic ‘Dettol’. Dettol wins Trademark Infringement

The Hon’ble Court also imposed a cost of ₹ 1.0 lakh on the manufacturer of ‘Devtol’ hand sanitizers and directed that the amount be deposited to the Juvenile Justice Fund within a week.

The High Court order came on a suit by Reckitt Benckiser (India) Pvt Ltd, manufacturer of a well-known antiseptic which is sold under the registered trademark and logo ‘Dettol’(TM Application Number 1576501, 1344934, 1145430, 1036911, Etc) , against Mohit Petrochemicals Pvt Ltd for selling hand sanitisers under the brand name ‘Devtol’( TM Application Number 4494428).
